TERMS & CONDITIONS

Welcome to the campaign website for Julie Settle for City ("we," "our," or "the Campaign"). By accessing or using our website, mobile site, or online services (collectively, the "Site"), you agree to comply with and be bound by the following Terms and Conditions ("Terms"). Please read them carefully. If you do not agree to these Terms, you must not use this Site.

2. Campaign Contributions and Donations

All political contributions made through the Site are processed via our third-party provider, Anedot, and are subject to Florida Statutes Chapter 106 regarding campaign financing, as well as local St. Augustine ordinances. By making a donation, you certify under penalty of perjury that:

  • You are a United States citizen or a lawfully admitted permanent resident (green card holder).

  • The contribution is made from your own personal funds or permissible corporate funds up to the legal statutory limit per election, in strict accordance with Florida campaign finance laws.

  • You are not a foreign national prohibited from contributing to U.S. political campaigns.

  • You are using your own personal credit/debit card or financial account, and not a card or account issued to another person or entity.

  • Contributions to political campaigns are political contributions and are not tax-deductible for federal or state income tax purposes.

3. Intellectual Property Rights

Unless otherwise indicated, the Site and all content and other materials therein, including, without limitation, the Julie Settle for City logo, and all designs, text, graphics, pictures, information, data, software, sound files, other files, and the selection and arrangement thereof (collectively, "Campaign Materials") are the proprietary property of the Campaign or its licensors and are protected by U.S. and international copyright and trademark laws.

You are granted a limited, non-sublicensable license to access and use the Site and electronically copy and print to hard copy portions of the Campaign Materials for your informational, non-commercial, and personal use only.

4. Prohibited User Conduct

You agree that you will not use the Site for any purpose that is unlawful or prohibited by these Terms. Prohibited activities include, but are not limited to:

  • Engaging in any behavior that disrupts, degrades, or interferes with the operation of the Site.

  • Attempting to bypass or breach any security measures implemented on the Site.

  • Using any automated system, including "robots," "spiders," or "offline readers," to access the Site in a manner that sends more request messages to our servers than a human can reasonably produce in the same period.

  • Posting or transmitting any harassing, defamatory, obscene, abusive, or offensive material through our contact or volunteer submission forms.

5. Text Messaging and Mobile Communications

By providing your phone number to the Campaign, you consent to receive recurring text messages, alerts, and updates from Julie Settle for City.

If you access Anedot or any other third-party website from the Site, you do so at your own risk and understand that these Terms and our Privacy Policy do not apply to your use of those external platforms. You are encouraged to review Anedot's terms and privacy rules separately.

7. Limitation of Liability and Disclaimer of Warranties

The Site and Campaign Materials are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, the Campaign disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

In no event shall Julie Settle for City, its campaign committee, staff, volunteers, or agents be liable for any direct, special, indirect, or consequential damages, or any other damages of any kind, arising out of or in any way connected with the use of or inability to use the Site or the Campaign Materials.

8. Indemnification

You agree to defend, indemnify, and hold harmless Julie Settle for City, its campaign committee, officials, employees, volunteers, and agents from and against any claims, damages, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

9. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, without resort to its conflict of law provisions. You agree that any action at law or in equity arising out of or relating to these Terms shall be filed only in the state or federal courts located in St. Johns County, Florida, and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action, or proceeding.
